Changing Criminal Laws in Tennessee

One major rule change in Tennessee that may affect some of our clients involves how Tennessee police officers are now allowed to ask people they suspect of drunk driving to submit to a breath test, also known as a breathalyzer, a blood test or both.

This change in how officers try to gather evidence against you may confuse some people. They aren't sure if they need to submit when they hear something new or when an officer asks them something that sounds intimidating, like submitting to giving blood, which could have important side effects to your health.

The fact remains that you are never under any obligation to give officers evidence that they can use against you. You have implied that you consent to certain testing as part of the conditions of your driving privilege, but if you do not want to give blood just because an officer asks, then don't. Under Tennessee law, however, violation of the implied consent law, by failing to submit to a breath or blood alcohol content test, may result in revocation of your driving privileges whether or not you are successful in defending a corollary driving under the influence charge.
